A Major Legal Shift in Gender Recognition
In a significant and controversial move, the Indian Parliament has passed the transgender rights bill in India, amending the Transgender Persons (Protection of Rights) Act 2019, fundamentally altering how transgender identity is legally recognized in the country.

According to The Hindu report; the bill was passed in the Lok Sabha by voice vote amid protests and opposition walkouts, signaling deep political division on the issue.

End of Self-Identification?
The most critical change introduced by the amendment is the removal of the concept ” self-perceived gender identity”. Under the 2019 law, individuals could declare their gender identity without mandatory medical intervention.

With the new amendment, this provision has been replaced by a system requiring verification.
Union Minister Virendra Kumar defended the move, stating the changes aim to ensure that ” benefits reach the right individuals” and to prevent misuse of welfare schemes.

Medical Boards to Decide Identity
Under the revised framework, individuals must now undergo evaluation by a medical board before being legally recognized as transgender. The district magistrate will issue certification only after such identity is confirmed.

This marks a shift from self-identification to institutional validation, raising concerns among activists.
One activist organization slammed the move, saying it “denies identity and autonomy” and forces individuals into “invasive procedures” to prove their identity.

Opposition and Protest Intensify
The bill has triggered strong backlash both inside and outside parliament. Several opposition leaders staged walkouts during the vote, calling the amendment “regressive”.

Critics argue that the law contradicts the famous NALSA v Union of India ruling, where the supreme court protected the right to self-identify gender.
On the streets, protests have emerged with activists demanding the rollback of the bill. Social media campaigns and demonstrations reflect widespread concern within the LGBTQ+ community.

A Nation Divided on Rights Versus Regulation
The administration contends that stronger measures are necessary to prevent fraud and streamline benefits. However, critics see the amendment as a rollback of hard won rights.
