Delhi HC Gives ED Deadline: Kejriwal’s Case to be Heard April 3

28 March 2024, 10:20 Am – The Aam Aadmi Party criticized the Enforcement Directorate for failing to respond to Chief Minister Arvind Kejriwal’s lawyers’ questions in the High Court regarding his arrest. The court didn’t immediately grant relief to Kejriwal, whose arrest by the ED in a money laundering case linked to the excise policy ‘scam’ was challenged. The BJP asserted that Kejriwal couldn’t get relief due to concrete evidence against him. The court asked the ED to respond by April 2 and set April 3 for final disposal.

Arvind Kejriwal Arrested –  ED Requests Time to Respond in Court

The Enforcement Directorate requested the Delhi High Court for time to respond to Arvind Kejriwal’s plea challenging his arrest in a money-laundering case linked to an alleged excise policy scam. Additional Solicitor General S V Raju cited the petition’s bulkiness and requested three weeks for a response. Kejriwal’s counsel, AM Singhvi, accused the agency of delay tactics. The matter is deferred for further consideration by Justice Swarana Kanta Sharma. Kejriwal was arrested on March 21 and remanded to ED custody till March 28.

Arvind Kejriwal, the Chief Minister of Delhi, was arrested by the Enforcement Directorate (ED) on Thursday. This arrest is connected to a case involving money laundering related to a suspected scam in the liquor policy.

Legal Battle on Arrest of Arvind Kejriwal By ED:

Earlier in the day, the Delhi High Court declined to offer immediate protection to Kejriwal from potential legal actions in this case. Kejriwal has challenged the summons issued by the central probe agency in the Delhi High Court and has requested interim protection. The court is scheduled to hear this matter on April 22.

Previous Proceedings: The ED had previously lodged two criminal complaints against Kejriwal in the Rouse Avenue Courts of Delhi, accusing him of not complying with their summons. To date, Kejriwal has received nine such summons from the central probe agency. Last week, Kejriwal appeared before the ACMM court and was granted bail upon providing a bail bond of Rs 15,000 and a surety of a similar amount. The next hearing for this matter is set for April 01.

Allegations on Arvind Kejriwal:

The ED has alleged that Kejriwal failed to adhere to the summons issued to him, although Kejriwal claims these summonses are unlawful. He did, however, inform the ED that he would be available for questioning via video conferencing after March 12. Additionally, leaders of the Aam Aadmi Party, Manish Sisodia and Sanjay Singh, have been arrested in connection with the same money laundering case and are currently in judicial custody.

Accusations by ED: The ED alleges that a conspiracy was orchestrated to provide certain private companies with a 12 percent profit margin in the wholesale liquor business, even though this detail was not recorded in the minutes of meetings of the Group of Ministers (GoM). The agency also claims that Vijay Nair, along with others, coordinated this conspiracy with the South Group to grant wholesalers unusually high profit margins. According to the ED, Nair acted on behalf of Chief Minister Arvind Kejriwal and Manish Sisodia.
